Legal Alert: Department of Labor Issues New Family Medical Leave Act Forms

The Department of Labor recently issued new forms for employers to use in connection with the Family Medical Leave Act. In general, the Family Medical Leave Act is applicable to employers with 50 or more employees and allows employees to take unpaid, job-protected leave in the event of a serious health condition, birth or adoption of a child or due to a family member’s call to active military duty. The new forms provide both the required notices for covered employers to post as well as certification forms for employers to provide to employees who are requesting leave for a covered reason. Employers are not required to use these specific forms and employers may make some modifications to the forms provided by the DOL. These forms are not applicable to the notices and certifications required for Emergency Family Medical Leave Act leave under the Families First Coronavirus Response Act. The DOL has issued separate notices and forms for use in connection with FFCRA leave.
