New Guidance on Workplace Harassment

The United States Equal Employment Opportunity Commission (“EEOC”) recently issued extensive new guidance on harassment in the workplace. The new guidance addresses the increase in virtual workplaces and the impact of technology and social media on harassment in the work environment. The guidance focuses on the three components of harassment claims: (a) covered bases and causation, (b) discrimination with respect to a term, condition or privilege of employment and (c) employer liability. Further, the guidance is illustrated with 77 examples of harassment in different situations.
