Legal Alert: New Law Affects Indiana Recorded Documents
Governor Eric Holcomb signed HEA 1056 into law today effectively dispensing with a requirement that documents must contain both a notary and witness proof in order to be recorded. The requirement that recordable documents be both witnessed and notarized happened inadvertently through the language of a 2020 bill. The former standard requiring that a document contain either a proof or an acknowledgment has been reinstituted.
