Importance of Delegation of Health Care Authority for Parents of Minor Children

Indiana law permits parents of minor children to delegate authority to consent to health care on behalf of their minor children during times when parents are not reasonably available to consent.  A Delegation of Health Care Authority is especially useful during periods when parents may be traveling without their children and the children remain in the care of other friends or family members.  The Delegation permits individuals caring for the minor children to seek medical care for the children if the need arises.

The requirements for a Delegation of Health Care Authority are that it must be in writing, signed by the person delegating authority, witnessed by another adult, and may specify conditions on the authority designated.  The Delegation can be revoked by the delegating parents at any time. This document is an important and useful part of the estate plan of parents of minor children.
